Heh, I like over-analyzing the state of law enforcement in a children's video game game where a fat cartoon plumber man amputates a squid's arms and cleans an eel's teeth.

Yeah, the Pianta Police should have detained him as they want to ask questions surrounding the vandalism of a figure of a similar silhouette (Mario matches the description of the wanted guy). However, if they ran an ID check, Mario clearly has no criminal history or warrants (unless they filed out an arrest warrant on the very little details they have on very terrible visual and witness testimonies), and in fact, Mario is a well-known celebrity in Mushroom Kingdom known for being heroic. Freaking hell, Mario just took down a goopy Piranha Plant right when he arrived, so there ARE witnesses already who can defend for Mario being innocent. Additionally, later on, Shadow Mario messes around with the denizens, and surely...they would have seen Mario chase after the doppleganger and then realize something is up...but at that point of the story, the whole imprisonment subplot for Mario is forgotten. Honestly, after getting entangled in the cluster---- law system that is Isle Delfino, I wonder why the hell Mario still wants to vacation there after all.

Another question that I wish was answered is if Isle Delfino is even part of Mushroom Kingdom. Yeah, they may have exotics but that doesn't necessarily mean that it's not owned by Mushroom Kingdom in a similar vein of how the US owns Hawaii and subject to its laws. This is when our headcanon runs into play hahaha.

Then again, Mushroom Kingdom sends out an entire police fleet running after two morons who vandalized a scoreboard in a stadium and did nothing when a stadium gets blown up by a huge explosion, but at least they noticed who actually was responsible and chased the right people.

Meanwhile, Diamond City Police gets their entire fleet taken out by soccer balls.

Now that I think about it, Bowser should've kidnapped and left Isle Delfino, so Mario either obeys Isle Delfino and stays detained and Peach remains kidnapped or Mario has to break the law again to rescue Peach. Bowser's plot does depend on Isle Delfino actually enforcing it, but just imagine the legal conundrum that'll give Mario that'll make Bowser cackle with joy.

I don't think kidnapping Peach on Delfino was Bowser's operation, rather it was Bowser Jr's. If you look at the whole thing less as an evil plot and more as a father-son bonding experience, it starts making more sense. It's like a dad taking his son on a fishing trip or something. Jr. is allowed to plan the trip, pick the bait and hold the fishing rod, and Bowser's mostly hands-off, just assisting with the difficult parts like handling the hooks, helping with reeling in the catch, and fighting off the fat plumber bent on revenge. Jr. didn't think to leave the island because he was banking on Mario being locked up for good, and didn't have a contingency plan in case the Piantas decide to release him on parole with a community service stipulation. Mostly because he's a kid and lacked the foresight to anticipate the whims of the law.

As for the trade sanctions: The Mushroom economy is apparently notoriously terrible. It's possible they tried something like that off-screen later and got laughed out of the office because their threat lacked any bite.

And that paradise has *no traffic* to speak of and the beaches are surprisingly devoid of the usual nasty infestation of tourist humans.

Of course Bowser Jr. wouldn't be aware there are several forms of punishment for various different crimes (vandalism probably wouldn't get you locked up for life without parole), and those differ on country too (who knows what Isle Delfino is in relation with Mushroom Kingdom). After all, Mushroom Kingdom has sent out entire fleets of police for drawing on a scoreboard while Isle Delfino sends out two police for painting all over the place and threatening Isle Delfino's revenue and way of life as a tourist hot spot).

Actually, Mushroom Kingdom's economy is tanking. It's why Beanbean Kingdom established a border gate at Stardust Fields after all. Clearly, Mushroom Kingdom has serious problems with the economy to the point too many victims try escaping to Beanbean Kingdom and take advantage of its superior currency (and perhaps Mushroom Kingdom is also suffering from overpopulation and sky-high cost of rent that requires constant partying and platforming every. single. day.) This is despite income inequality not really being documented. On the other hand, there are Bandits that steal coins for you from hotels without demanding payment.
