Are the files for 3D Land still on the SD card (as in, was the SD card reset with the system or was it bought new)? If the files are still there, the system will recognize them. Either way, game sounds like it's already been bought, it's like someone giving a game they owned to you.

I can't see 3D Land on the home menu
When I bought the system it had an SD card in it and I never reset it myself as I presumed it already was. I don't want to reset it now that I've got my own stuff on it.

Yes, of course it's legal. Game's already been bought, you're fine.
You're not going to see it on the home menu because the system is lacking the file needed to run the game. By clicking "redownload", the system will get that file. I'm not 100% sure on how this is done, but what I heard is ~90% of the game is on the SD card and the other 10% are the files on the system needed to access them. When the 3DS was reset, the files to run the game were removed.

Can I check by taking out the SD card and plugging it into a computer, if so do I need any additional software?

Yeah, as long as you don't modify anything, you can check the files. I'm not entirely sure what you'd be looking for, though.

@Alex95 I looked through the entire filesystem on the SD card and I did find something which looked a bit like the files for games but there were only two: I have bought two games on my 3DS since buying it (SML1&2) so I presumed it would be them.

Redownloading should be fine. Honestly, not sure why the extra precautions. Even if the games only partially downloaded, it's probably just going to delete or replace those files anyway.

@Jolly DönerMax I wasn't planning on freeshop and I'm asking if I can do anything to get to pay for it myself.

Also FYI I went to nintendo.co.uk (I live in UK) and it confirmed "You can already use this content on the device connected to this Nintendo Account."

And I know I could get a cartridge but nah I want it digital and it would feel kind of dumb to have the cartridge sitting around when I don't use it.
