Why is Nintendo afraid of fangames?

I won't use Sega as an example of a company that doesn't mind/supports fangames due to the "LOL THERE SO BROKE THEY TAKE WHAT THEY CAN GET" argument everyone loves to use. Instead I will use a company in a much better position, Valve. Look at all the hacks, fangames, mods, straight up remakes that have been made out of all their IP's over the past 10 years. Notice how waves of cease and desists weren't sent out and how profits weren't ruined because of it. Why does Valve not mind/ like enough to hire fans whereas Nintendo is quick to bring down the hammer of law?

its very selective, as seen they shut down am2r main site as well as pokemon uranium main site and they did shut down a smm fangame but they dont typically do much else unless its like super big and really impressive to the populace as they havent shut down any other major fangaming/fanhacking sites like mario fan games galaxy.

So who knows, most of the time other companies are down with it but sometimes they strike at some hacks or fangames, but with nintendo it seems to be rather sparatic and no one sure where the line is drawn for them.

Nintendo is out of touch with their fans and also a bit living in the past.

Ultimately, it boils down to money. They use copyright as a means to suck money bone-dry from their brands and if fans don't give them the money, then tough shit for them.

They aren't "afraid" of fangames. They just think it doesn't feed them money while they view their fans and cynical pirates and bootleggers as one and the same, so they'll take it down.

Remember when they would just purchase the rights to infringing works?

Like that porno?
Technically they bought the rights because it wasn't infringing their works since legally the porn would be considered a parody and thus legally protected.

i think it's because they don't want their audience to think that the stuff ''fans'' do are official , so it reflects the quality of their brand.

Copyright can also be involved , they are pretty attached to their intellectual property and i don't blame them , they have the right.

I'm just happy they don't mind mods and hacks.

They also don't seem to mind blatant ripoffs (case in point, Super Woody and the sequel Super Woody Run) and straight up bootlegs (GRAND DAD). Probably because those guys can actually afford lawyers and Chinese copyright law (where applicable, obviously) would probably find in favor of the bootleggers.

My mistake.
Good, I was just beginning to wonder that my battle axe isn't getting itself acquainted enough with other people.

Yes, they'll go after the weak like Mario Kart gold-diggers money whoring bullies.

While I don't disagree that they have the right, anyone also has a legal right to call anyone on the street an idiot *bleep* and flash your obscene hand gesture but doesn't mean you should.

Again, it's really all about money, not really how much they genuinely care about their product and making people happy and attached to Nintendo world. It's all good if fans grant them unconditional love, but only if the love is in the form of currency.

Also, they do mind mods and hacks as they've indirectly intimidated Project M developers (official tournaments and developers were extremely anxious to the point where they canceled development of that mod from fear of legal repercussions), though mods aren't their primary target because they actually lost in a court case Lewis Galoob v. Nintendo and they probably don't want a repeat of that. They still do *bleep* like mentioning "PM" or "Project M" as "criminal activity" in Miiverse.

Finally, though, I'm thankful their consoles are capable of being modded in an actual way, unlike Playstation and Xbox.
